Latitude Legal and its subsidiaries and affiliated companies (“Latitude”, “Latitude Legal” or “Company”) takes your privacy seriously. We want you to know how we collect, use, disclose, and protect your personal information.

Scope

This Privacy Notice only applies to (a) users of our websites (including but not limited to https://latitudelegal.com), as they may be updated or moved over time, (the “Website”), (b) applicants applying to work at Latitude Legal, either as employees or as independent contractors (“Applicants”), and (c) contacts at our clients and business partners (“Business Contacts”). This Privacy Notice does not cover (i) Latitude Legal’s current or former workers, e.g., employees and independent contractors, or (ii) their spouses, dependents, or beneficiaries because Latitude Legal has provided these individuals with a separate notice.

For purposes of this Privacy Notice, “personal information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual.

Children’s Protection

We do not collect information from anyone under 16 years of age. The products and/or services we provide, together with our Website, are all directed to individuals who are at least 16 years old. If you are under the age of 16, you are not authorized to use our services or the Website.

Notice at Collection for California Residents

We collect the categories of personal information identified in Section 1, below, for the purposes identified in Section 3, below, and retain personal information for the period described in Section 5, below. We may “sell” or “share” your personal information, as the California law defines those terms. We do not collect or process sensitive personal information for the purpose of inferring characteristics about you. To the extent you provide Latitude Legal with personal information about other California residents, you are responsible for providing this notice to them.

1. The Categories of Personal Information We Collect About You

We may collect the following categories of personal information:

• Identifiers, for example, name, e-mail address, and telephone number if you fill out a contact form.
• Internet, or other electronic network activity information, for example, search history on our website, and interactions with Latitude Legal’s Internet website.
• Communications Data, for example, during our communications with you, we collect the content of these communications as well as metadata about the communications, i.e., date and time of the web message.
• Professional or employment-related information, for example, title, employer, business contact information.

In addition, we may collect the following personal information from Applicants:

• Professional or employment-related information, for example, qualifications, employment history, business contact information, title, educational institutions attended, degrees and certifications, licenses, work experience and previous employers, and professional memberships and affiliations.
• Non-public educational information, for example, academic transcripts.
• Sensory or Surveillance Data, for example, voice-mails, audio/visual recordings of interviews, and footage from video surveillance cameras.
• Other details, for example, hobbies and leisure activities or membership in voluntary/charitable/public organizations, for example, as stated on the Applicant’s resume.
• Background Screening, for example, references, identity verification, and criminal history, in accordance with applicable laws.
• Inferences, for example, an Applicant’s suitability for the job sought based on educational and professional background.
• Sensitive personal information, to the extent necessary, for example, social security number to conduct background checks, health information if the Applicant experienced a health emergency while on Latitude Legal premises, or information about religion or disabilities if the individual requests an accommodation.

Note on Sensitive Personal Information: Latitude Legal only uses sensitive personal information as necessary to perform the services the average person would reasonably expect when requesting those goods or services, to maintain the quality of our services, or for other purposes not granted the right to opt out under the California Consumer Privacy Act. The Company does not infer characteristics from sensitive personal information.

Do We Use Cookies?

Yes. Cookies are small files that the Website or our service provider transfers to your computer’s hard drive through your Web browser that enables the Website’s or service provider’s systems to recognize your browser and capture and remember certain information. We use cookies to help us understand how users use the Website. For example, cookies gather information about how long you spend on a web page so that we can understand what web pages are of most interest to users. We may also deploy cookies in web-based emails we send to you.

The links from the Website do not imply that we endorse or have reviewed the Third Party Sites. We suggest contacting those sites directly for information on their privacy policies.

2. The Categories of Sources from Which We Collect Your Personal Information

• You, for example, when you register with our Website, fill out your job application or other forms you complete for us, and any information you provide us during the course of your relationship with us.
• Service providers and vendors, for example, analytics providers, IT, and system administration services.
• Affiliated companies, for example, so that we can assist other companies in the Latitude Legal family of companies in providing you with services.
• Automated technologies, for example, browsing activity collected by automated technologies on the Website.
• Third parties, for example, job references, personal or professional referrals through our network, lawyers, bankers, auditors, and insurers who provide consultancy, banking, legal, insurance, and accounting services.
• Public sources, for example, public databases and publicly available social media such as LinkedIn.
• Surveillance/recording technologies installed by Latitude Legal, for example video surveillance in common areas of Latitude Legal facilities, voicemail technologies, and audio recording technologies with consent to the extent required by law.
• Government or administrative agencies, for example, law enforcement, public health officials, and other government authorities.
• Acquired company, if Latitude Legal acquired another entity, Latitude Legal might collect personal information from that entity.

3. The Purposes for Which We Use Your Personal Information

A. Applicants

• Evaluating Applicants’ qualifications or suitability for employment with Latitude Legal.
• Conducting background checks including criminal, credit and education in accordance with applicable law.
• Creating a talent pool for future job openings.
• Keeping you informed of Latitude Legal services, news, and wider developments in your chosen field.
• Demonstrating Applicants’ agreement to, or acceptance of, documents presented to them, e.g., arbitration agreement, acknowledgment of application, offer letter.
• Promoting Latitude Legal as a place to work.

B. Business Contacts

• Fulfilling your recruitment needs.
• Advertising and marketing.
• Providing resources and support like expert management advice, events, and webinars.

C. All Individuals

• Evaluating and improving our services.
• Facilitating communications, for example, by collecting and organizing contact information, establishing means of communications, and communicating with current and prospective customers, including regarding questions and feedback.
• For administering contests and sweepstakes, to the extent that you choose to participate.
• Informing you of any changes to the services, your account (if applicable), this Privacy Notice, or any other policies or terms in relation thereto.
• Auditing including, but not limited to, counting impressions to unique visitors, verifying positioning and quality of impressions, and auditing compliance with the law.
• Detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity.

Incidental Purposes: Any incidental purposes related to, or in connection with, the above.

Automated Decision-Making Technology: Latitude Legal does not use automated technologies to replace or substantially replace human decision-making for significant decisions, e.g., decisions about hiring, assignment of work, or compensation.

Latitude Legal may use automated technologies to capture the conversation during candidate interviews in real time and then create summaries of the conversation, thereby allowing recruiters to fully engage in the interview process. Recruiters use the summaries as needed to refresh their memories, in conjunction with the person’s application, the recruiter’s own notes, and other relevant information, to evaluate candidates. Every decision to interview or decline a candidate is made by a human.

4. How We May Disclose Your Personal Information

Latitude Legal discloses personal information as necessary for the purposes described in Section 3 above to the following categories of external recipients:

• Clients and potential clients: Latitude Legal discloses personal information of Applicants with its clients and potential clients to facilitate placement with the client or potential client.
• Service providers and contractors: Latitude Legal discloses your personal information to service providers and contractors for the purposes above to assist us in meeting our business needs and contractual and legal obligations.
  • Service providers and contractors include auditors, administrative service providers, law firms, and any other entity providing services to Latitude Legal.
  • Service providers that support our communications services may receive communications as they are sent to and from Latitude Legal in the course of supporting these services. This may include receiving information that you enter into search functions, chatbots, and online forms on our Website.
• Affiliated companies: Other companies within the Latitude Legal family, for example, to provide you with our services.
• Government or administrative agencies: For example, Latitude Legal may report unlawful activity to law enforcement.
• Required Disclosures: We may be required to disclose personal information in a court proceeding, in response to a court order, subpoena, civil discovery request, other legal process, or as otherwise required by law.
• Legal Compliance and Protections: We may disclose personal information when we believe disclosure is necessary to comply with the law or to protect the rights, property, or safety of Latitude Legal, our users, or others.

Aggregated and Deidentified Information

We may aggregate and/or deidentify information, use it internally, and disclose to third parties. Neither Aggregated Information nor Deidentified Information (defined below) is personal information.

• “Aggregated Information” refers to information about a group of individuals from which the individually identifiable information has been removed. An example of Aggregated Information would be the statistic that 20 people used our website’s contact form on a given day.
• “Deidentified Information” means information subjected to reasonable measures to ensure that the deidentified information cannot be associated with the individual. An example of Deidentified Information would be the data point that an unidentified visitor first entered the Website through our main web page. We maintain Deidentified Information in a deidentified form and do not attempt to reidentify it, except that we may attempt to reidentify the information just to determine whether our deidentification processes function correctly.

5. How Long We Keep Your Personal Information

For Applicants:

If Latitude Legal hires you, the information collected about you during the job application process may become part of your personnel file and may be used to administer the employment relationship and for related reporting and recordkeeping purposes. Latitude Legal will retain this application information for the entire duration of your employment relationship with Latitude Legal and for as long thereafter as permitted or required by applicable law. Latitude Legal makes its document retention schedule available to employees for review.

Latitude Legal will retain information of Applicants who are not hired in accordance with record retention laws. During that time, we may use your information to consider you for positions in addition to the position(s) for which you initially applied.

For All Other Individuals:

Latitude Legal retains your personal information for the duration of the Company’s relationship with you. Latitude Legal will retain personal information longer as necessary to comply with legal, administrative, or procedural requirements, for example, a litigation hold.

6. Additional Information for California Residents

This Section provides additional information for individuals who reside in California.

A. Additional Information About Disclosures of Personal Information

We may disclose your personal information to third parties for the following “business purposes” as that term is defined under the California Consumer Privacy Act (CCPA) and as a supplement to the disclosure described in Section 4 (How We May Disclose Your Personal Information), above:

• Service Providers: We may disclose any of the categories of personal information listed above to service providers for the business purpose of performing services on our behalf, as well as (a) helping to ensure security and integrity, (b) debugging, (c) short-term transient use, (d) internal research, and (e) activities to maintain or improve the quality or safety of a service or device.
• Professional Advisers and Related Third Parties: We may disclose any of the categories of personal information listed above to the professional services providers listed in Section 4, above, for the business purpose of auditing compliance with policies and applicable laws in addition to performing services on the Company’s behalf.
• Affiliated Companies: We may disclose any of the categories of personal information listed above to other companies within the Latitude Legal corporate group for the business purposes of: (a) auditing compliance with policies and applicable laws, (b) helping to ensure security and integrity, (c) debugging, (d) short-term transient use, (e) internal research, and (f) activities to maintain or improve the quality or safety of a service or device.

B. Sales and Targeted Advertising

We do not “sell” your personal information as most people would understand that term, meaning that we do not disclose your personal information to any third party in exchange for a monetary payment. However, as is common practice among businesses operating online, we may allow third parties to receive information about you via cookies for purposes of analyzing and optimizing our services, to personalize your online experience by providing advertisements that are more relevant to you, and for statistical research and analytics. These activities may be defined as “sale” of personal information or use of personal information for targeted advertising (or “sharing” for cross-context behavioral advertising).

In the last 12 months, we have disclosed Internet or Other Electronic Network Activity Information to our marketing partners (marketing and analytics partners, advertisers, and social media platforms). We disclose this personal information in order to deliver marketing messages, tailor advertising on the Website and in other interactions that you have with us while online, and to help us understand the effectiveness of those marketing and advertising efforts. We have no actual knowledge that we have sold or “shared” the personal information of children under 16, in the last 12 months and we have no intention to do so.

We understand that targeted advertising isn’t for everybody, and you have options. You may modify your cookies settings as described above in Section 1 of this Privacy Notice, or opt-out of this type of activity using the methods described below.

C. Data Rights

Subject to applicable law, you may have the following rights:

• Right to Know: The right to submit a verifiable request to know the personal information collected about you and how the Company handles it.
• Right To Delete: The right to submit a verifiable request for deletion of your personal information that you provided to Latitude Legal.
• Right to Correct: The right to submit a verifiable request for the correction of inaccurate personal information maintained by Latitude Legal, taking into account the nature of the personal information and the purposes of processing the personal information.
• Right to Opt Out of Sale/Targeted Advertising: The right to opt out of the sale of your personal information and the disclosure of your personal information for cross-context behavioral advertising (“sharing” or “targeted advertising”).
• Non-Discrimination: The right not to be discriminated against for exercising any of your privacy rights under the CCPA. To be clear, we do not tolerate unlawful discrimination of any kind.

D. How to Exercise Your Data Rights

To request to know, delete, or correct your personal information, contact [email protected]. Latitude Legal will respond to these requests in accordance with applicable law if it can verify the identity of the individual submitting the request.

To opt out of sale/targeted advertising, you may implement a browser setting or extension to communicate your selling and sharing preferences automatically to the websites you visit. In particular, in accordance with applicable law, we honor the right to opt out of the sale and sharing of your personal information as signaled by a universal opt out signal or Global Privacy Control (“GPC”). To enable GPC, you can visit the Global Privacy Control page at https://globalprivacycontrol.org. If you download a supported browser or extension and exercise your applicable privacy rights with GPC, we will turn off certain third-party cookies on our website after our website detects a GPC signal. However, if you visit our Website from a different device or from a different browser on the same device, you will need to opt-out or use an opt-out preference signal for that browser and/or device.

E. How We Will Verify Your Request

To verify your identity for a request to know, correct, or delete, we match personal information that you provide us against personal information we maintain in our files. The more risk entailed by the request (e.g., a request for specific pieces of personal information), the more items of personal information we may request to verify your identity. If we cannot verify your identity to a sufficient level of certainty to respond securely to your request, we will let you know promptly and explain why we cannot verify your identity.

F. Authorized Agents

You may designate an authorized agent to exercise your right to know, to correct, or to delete. If an authorized agent submits a request on your behalf, the authorized agent must submit with the request another document signed by you that authorizes the authorized agent to submit the request on your behalf. In addition, we may ask you or your authorized agent to follow the applicable process described above for verifying your identity.

If we change this Privacy Notice, we will post those changes on this page and update the Privacy Notice modification date above.
