Patent Attorney (Remote)

Our client, a leading AI technology company specializing in providing cutting-edge solutions and services to defense and government sectors, is seeking a Patent Attorney to work with the company on a contract engagement basis. The Patent Attorney will be responsible for identifying, evaluating, and protecting patentable and strategic inventions and minimizing the risk that the company's products infringe on the valid intellectual property rights of others. This position will also collaborate with the company’s product development team and review, draft, and coordinate patent applications, patent prosecutions, intellectual property documentation, and related agreements.

In this role, you will:
  • Work with company’s engineers to identify patentable technology, suggest courses of action to best protect proprietary technology, and help drive the process for new patent applications.
  • Provide clear and informed counseling to stakeholders engaged in research & development, manufacturing, business development/partnering, portfolio and lifecycle management, and commercialization activities.
  • Prepare and prosecute U.S. patent applications, and as needed, work with outside counsel and foreign associates for preparation and prosecution of international patent applications.
  •  Assist with the analysis of patent office actions, gather relevant data and information, and draft responses to those actions to obtain allowance of claims.
  •  Conduct prior art searches and invalidity searches.
  •  Provide legal advice on patentability of inventions, validity of patents, and patent infringement.
  •  Assist in managing patent docket, completing docket reviews, and providing recommendations regarding patent maintenance and foreign filing decisions.
  • Align the patent portfolio with short- and long-term business needs and priorities by identifying and capturing patenting opportunities that arise in connection with company R&D efforts.
  • Apply knowledge of patent trends and case law developments, in combination with technical understanding, to devise patent strategies and advise stakeholders accordingly.
  • Assist with and/or conduct due diligence assessments and provide counseling based on these assessments (including freedom-to-operate, infringement and validity analyses), evaluate associated risks, and develop risk mitigation strategies.
  • Deliver results on-time, on-target and within-budget according to team goals. Keep leadership informed of progress.
  • Perform other duties as required within the nature and level of work.
Competencies and Skills
  • JD from a top U.S. law school and active bar membership in good standing.
  • 5-7+ years of experience in patent prosecution and counseling in a corporate setting and/or law firm; law firm experience preferred.
  • Eligible to practice before the U.S. Patent and Trademark Office
  • Advanced Degree or equivalent experience in Engineering, preferably software engineering good standing.
  • Experience working with software, artificial intelligence and/or technology and patents.
  • Strong written and verbal communication skills. Service-oriented focus with ability to work as part of cross-functional teams and drive results. Highest integrity, excellent judgment, and the ability to pro-actively recognize and effectively communicate legal issues to engineers and management.

Compensation
The annualized compensation for this position ranges from $175,000 to $250,000 or more. Pay is based on numerous factors including but not limited to work experience, qualifications, credentials and location. In addition to salary, Latitude Engaged Professionals are W2 employees of Latitude and are eligible for full benefits when working in roles for 20 hours per week, including a Qualified 401k plan. Benefits-eligible Latitude employees receive complimentary Group Life, LTD and AD&D and professional liability insurance. Latitude Attorneys also receive a CLE and Professional Expense stipend.
