In-House Biopharmaceutical Ad Promo Legal and Regulatory Counsel (Engagement)

Latitude has an immediate, long-term need for a life sciences attorney with significant promotional and consumer-directed advertising experience to support a growing biopharmaceutical company, engaged within their in-house legal department.

This in-house counsel role is a long-term (i.e., six months - one-year) contract engagement, involving legal and regulatory counsel on advertising and promotional (Ad Promo) materials, compliance with FDA and FTC regulations, risk assessment of promotional claims, advising on product labeling and communications, and ensuring adherence to relevant state and federal healthcare laws. This role will also include reviewing marketing strategies, providing guidance on social media and digital campaigns, and working closely with cross-functional teams, including Medical, Regulatory, and Commercial divisions.

Role Expectations and Long-Term Potential:

  • The role focuses heavily on Ad Promo compliance work, but due to the company's small (but mighty!) legal team, the candidate will also gain exposure to other legal and regulatory projects.

  • The position is long-term, with the potential for renewal beyond six months if the candidate proves successful.

  • The ideal candidate must have experience in Ad Promo but will be encouraged to be a contributing member in the more expansive legal and regulatory team projects.

Responsibilities Include:

  • Reviewing promotional materials and tactics, including social media and healthcare professional and consumer-directed advertising.

  • Providing regulatory environment updates on key activities at FDA, EMA, and other global agencies that may affect product approvals and marketed products.

  • Partnering and collaborating with other departments and functions.

  • Assisting in the preparation of organizational and leadership communications.

  • Ability to work both in a strategic big-picture mode, as well as tactically, including the capability to “roll up one’s sleeves” and work in detail.

  • Flexible and possessing a commercial, business focus in approaching this position.

  • Work well independently, while meeting aggressive deadlines and prioritizing multiple matters.

  • Collaborate closely with internal clients (including scientific and business leaders) on strategic transactions.

  • Maintain an independent and objective perspective while developing and maintaining a strong partnership with client organizations and protecting the company’s interests.

Basic Requirements for the Biopharmaceutical Ad Promo Legal and Regulatory Counsel:

  • Juris Doctorate (J.D.) degree from a nationally recognized law school.

  • Admitted to the Bar (and in good standing) in at least one state or the District of Columbia.

  • At least 3+ years of experience in a healthcare/life sciences law role in the biopharmaceutical industry, with significant experience supporting branded biopharmaceutical products, including participation in promotional and medical review processes.

  • Prior experience advising on Ad Promo legal and regulatory issues, including FDA regulations, OPDP guidance, FTC advertising standards, and industry best practices.

  • Strong understanding of FDA promotional rules and guidance, including the review of DTC and HCP marketing materials, press releases, and digital advertising.

  • Excellent analytical, written, verbal, and interpersonal skills.

  • Outstanding professional references.

Position Details of the Biopharmaceutical Ad Promo Legal and Regulatory Counsel:
 

  • Type of role: Contract engagement

Compensation 
Pay: The annualized pay for this contract position ranges from $200,000 to $400,000 when calculated on a full-time basis.
Pay for contract roles is based on multiple factors including but not limited to work experience, qualifications, credentials, location, market supply/demand, and the candidate’s preference (each candidate’s pay rate affects the client bill rate which can affect the candidate’s competitiveness for the position.
Benefits: In addition to pay, all Latitude contract professionals receive complimentary professional liability insurance coverage. Latitude contract professionals are usually W2 employees of Latitude and are eligible for full benefits when working in roles for 20 hours per week. Benefits-eligible Latitude contract professionals receive complimentary Group Life, LTD and AD&D. A qualified 401k plan is also available. Benefits-eligible Latitude Attorneys also receive a CLE and Professional Expense stipend.
